BlueHopper Lighting System Component Coverage

BlueHopper Lighting’s comprehensive warranty provides you peace of mind with a guarantee that your BlueHopper Lighting system is free of any manufacturing defects or component failures for a period of 7 years for the base, lid, 5 years for light strands and power supply as components of the Permanent Roofline Lighting System, 3 years with the option to purchase an extended warranty for the flood and washer lights and their power supplies, 3 years with the option to purchase an extended warranty of up to 5 years for the Permanent Roofline Lighting controller, 1 year with the option to purchase an extended warranty for the landscape lights and other products – MR16, PAR36, and G4 BiPin bulbs, repeater, other controllers including flood and washer lights controller, Astro-timer, low voltage AC/DC dimmer, Gateway, cellular modem, related accessories, from the date of the original installation. In the event of component failure BlueHopper Lighting will provide replacement components directly to the consumer or to a Certified BlueHopper Lighting Installer through our standard return and replacement process. The determination of whether or not a component is defective, or has failed, shall be made at the sole discretion of BlueHopper Lighting with consideration given to the overall performance of the system. Once the first year of Permanent Roofline Lighting System coverage has expired, for Permanent Roofline Lighting base, lid, lighting strands, power supplies, and flood and washer lights, we will take into account the number of years of use from the original installation date through the date of your claim and reduce the amount of compensation accordingly. This limited warranty is void if the system is not used for the purpose for which it was designed, if it has been installed or maintained by anyone other than a certified and trained BlueHopper Installer, or if any non-BlueHopper component has been substituted into the system.

Installation and Repair Labor Cost Coverage

Authorized installers may offer their own labor warranty program. If you already have BlueHopper Lighting products or are in a quoting process, please follow up with your Installer directly to learn more.  Labor is not covered by BlueHopper Lighting and BlueHopper Lighting strongly recommends that lighting system owners obtain, at minimum, a labor warranty, and service and maintenance agreement from a Certified BlueHopper Installer.

Warranty Activation

The original consumer purchaser/property owner, (not installer) is covered during the life of the original warranty.  The original BlueHopper Lighting system owner has up to 90 days from purchase to activate their warranty.  Activation can be accomplished by registering your system online at www.BlueHopper.com.  Proof of purchase of the components and the installation date must be submitted at the same time. If the warranty is not activated within 90 days of installation the warranty will be considered null and void.

Compensation

This warranty does not cover damage to the BlueHopper Lighting system due to any cause not expressly covered herein.  Exclusions to the warranty coverage include, but are not limited to the following:

1) Components damaged during installation or repair not completed by a Certified BlueHopper Installer, and normal wear and tear.

2) Acts of God including but not limited to hail, lightning, damaging winds, hurricanes and tornados, snow or ice damage, etc.

3) Product damage as a result of roof, gutter, or soffit failure or structure settlement.

4) Roof replacement or building remodeling.

5) Damage caused by power washing, painting, cleaning solutions, or other modifications.

6) Altering the system outside of its intended use, or using non-BlueHopper substitute components to operate the system.

7) Any cost that the owner incurs that is not authorized in advance by BlueHopper Lighting.

8) Damage caused by accidents, negligence, abuse, misuse, mishandling, or improper maintenance.

9) Damage due to fire, vandalism, or civil disturbances.

10) Damages due to electrical malfunction such as power surges and electrical current fluctuations, corrosive environment installations.

11) Shading, sun fade, or variations in the color of your BlueHopper lighting products or discoloration caused due to algae, fungi, lichen, or cyanobacteria. Power failures, internet service interruptions, and tripped GFIs are not covered under this warranty.

Exclusions

The manner of compensation for a failed component covered under this warranty is at the sole discretion of BlueHopper Lighting and may be issued in the form of a cash settlement, or repair and/or replacement of the failed component. Any repair or replacement will be warranted for the remainder of the original warranty period.

Claims

To make a claim under this warranty, the covered owner needs to do so within 30 days of discovering the problem.  Claims can be initiated by entering details of the failure on our website at www.BlueHopper.com via the contact us page, or through your Certified BlueHopper Installer.  We may ask you to provide pictures of the system performance failure, and/or we may ask that you or your Certified BlueHopper Installer return the failed or damaged components to BlueHopper Lighting. We may require that you furnish proof of purchase details, respond to questions designed to assist with diagnosing potential issues, and follow BlueHopper Lighting’s procedures for obtaining warranty service.

Limitations

This Limited Warranty is exclusive, represents the sole remedy, and replaces all other warranties, conditions, representations, and guarantees, whether expressed or implied, including the implied warranties of merchantability and fitness for a particular purpose, whether by statute, at law, or in equity, and is limited in length to the express warranty provided above.  In no event shall BlueHopper Lighting be liable for incidental, compensatory, consequential, indirect, special, or other damages including but not limited to loss of use; loss of revenue; loss of actual or anticipated profits (including loss of profits on contracts); loss of the use of money; loss of anticipated savings; loss of business; loss of opportunity; loss of goodwill; loss of reputation; loss of, damage to, compromise or corruption of data; or any indirect or consequential loss or damage howsoever caused including the replacement of equipment and property, any costs of recovering, programming, or reproducing any program or data stored in or used with the product or any failure to maintain the confidentiality of the information stored in the product.  (a) in no event shall BlueHopper Lighting be liable for any consequential, indirect, incidental, special, exemplary, or punitive damages, lost profits or revenues or diminution in value, arising out of or relating to any breach of these terms, whether or not the possibility of such damages has been disclosed in advance by you or could have been reasonably foreseen by you, regardless of the legal or equitable theory (contract, tort or otherwise) upon which the claim is based, and notwithstanding the failure of any agreed or other remedy of its essential purpose. BlueHopper’s aggregate liability with respect to a defective component or system shall in any event be limited to the monies paid to BlueHopper for the failed part or the component of the Lighting system. In no event shall BlueHopper Lighting be liable for warranty, incidental, compensatory, consequential, indirect, special, or other damages for products not manufactured and sold by BlueHopper Lighting even though they may be used with Lighting Controller by BlueHopper Lighting. This warranty may not be changed or modified.  No one, including any representative or employee of BlueHopper Lighting, and any representative or employee of a contractor or installer, has authority to assume any additional liability or responsibility for BlueHopper Lighting, or in any way modify or change this warranty.

Changes

BlueHopper Lighting reserves the right to change this warranty at any time without notice.

Governing Law

This warranty shall be governed by and construed in accordance with the laws of the State of Texas.

Any legal suit, action or proceeding arising out of, or related to, these Terms shall be instituted exclusively in the federal courts of the United States located in the Northern District of Texas or the courts of the State of Texas located in Collin County, Texas although we retain the right to bring any suit, action or proceeding against you for breach of these Terms of Use in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to the venue in such courts.
